YOUR PRIVACY IS IMPORTANT TO US Clan Davidson Society in Australia, Inc (the Society). respects your privacy. All our Officers, representatives and contractors gathering or dealing with personal information are required to read this policy and understand their responsibilities when dealing with personal information. OUR PRIVACY PRINCIPLES The Society is not bound by the National Privacy Principles (NPPs) in the Privacy Act 1988 (the Act). But we have committed to adopt internal policies and procedures to ensure that personal information is dealt with in accordance with what we consider to be appropriate standards. FREQUENTLY ASKED QUESTIONS We generally do not disclose a member’s personal information to third parties. Exceptions include where we are required to disclose confidential information by force of law, and where the third party agrees only to use or disclose the information as authorised by the Society (this exception covers use of genealogical information in the Society’s records, which may be made available to members in the discretion of the Society, and typically will be made available - subject of course to any associated costs or expenses being paid for by the member, and all other conditions imposed by the Society being satisfied - the usual conditions being that the member use the information only for the purpose of their own personal genealogical research or such research on behalf of a relative). We never disclose personal information except in accordance with this policy. If you do not wish to provide us with all the personal information we request from you, you may not be able to access all information we provide online, or be a member of the Society, and we may not be able to comply with our own administrative procedures required for prudent management of the Society’s operations. We may need to collect sensitive information in some circumstances and for specific purposes (eg, where it is necessary for the establishment, exercise or defence of a legal or equitable claim and we have agreed to provide associated legal services). Where we are at liberty to do so, and it is practicable to do so, we will seek consent of living individuals before collecting their sensitive information, and inform them of the purpose at the same time. COLLECTION We generally need to collect individuals’ names and contact details in order to identify our members and potential members, and their authorised representatives, and to keep records required under legislation. We also collect individuals’ names and contact details so that we may better plan and implement initiatives intended to improve facilities, services and other things the Society makes available to members. Your representatives may hold personal information (eg, financial or bank account details) that we may need to access, for example if you are a Society member paying by direct transfer. Where we are at liberty to do so, we will use our best endeavours to seek your consent before obtaining your personal information from third parties. We also collect other personal information relating to you, for example genealogical information about you or your ancestors, which we are adding to a database of information relating to CDSA members and their relatives in the broadest sense. We also collect other personal information relating to you, for example your contact details so that we can keep you informed as to any marketing initiatives we think may be of interest to you. RESTRICTIONS ON ACCESS Where providing access would reveal evaluative information generated within the Society in connection with a commercially sensitive decision-making process, the Society may give you an explanation for the decision, rather than direct access to the information.
